ETHICS COMMISSIONER REFUSES TO DEAL WITH COMPLAINT ABOUT MP WAJID KHAN SWITCHING PARTIES AND KEEPING REPORT SECRET -- DEMOCRACY WATCH CALLS ON COMMONS COMMITTEE ON ETHICS TO ORDER ETHICS COMMISSIONER TO ENFORCE “HONESTY” RULE

OTTAWA - Today, Democracy Watch revealed that federal Ethics Commissioner Bernard Shapiro has refused to review the complaint it filed about federal MP Wajid Khan switching from the Liberals to the Conservatives and breaking his promise to release his report advising Prime Minister Stephen Harper on policy in the Middle East and Asia. 

Democracy Watch called on the House of Commons Committee on Access to Information, Ethics to call on the Ethics Commissioner to explain why he refuses to enforce the parts of section 2 of the Conflict of Interest Code for Members of the House of Commons (the MPs Code) which require MPs to be “honest”.

“Canadians have made it very clear that they want honest politicians, and obviously honesty in politics is key to having a democratic government, but the federal Ethics Commissioner continues to refuse to enforce the ethics rule that requires federal politicians to be honest,” said Duff Conacher, Coordinator of Democracy Watch.  “If federal politicians have any integrity, they will order the Ethics Commissioner to do his job properly and enforce the honesty rule and all other rules in their ethics code.”

The relevant parts of section 2 of the MPs Code are as follows:

“2.  Given that service in Parliament is a public trust, the House of Commons recognizes and declares that Members are expected, . . . (b) to fulfill their public duties with honesty and uphold the highest standards so as to avoid real or apparent conflicts of interests, and maintain and enhance public confidence and trust in the integrity of each Member and in the House of Commons; (c) to perform their official duties and functions and arrange their private affairs in a manner that bears the closest public scrutiny, an obligation that may not be fully discharged by simply acting within the law; . . .”
Democracy Watch’s January 23, 2007 complaint alleged that MP Khan violated the MPs Code by running as a Liberal in the last election and then switching for no valid reason to the Conservatives, and by breaking his promise to release the report he had prepared at the request of Prime Minister Harper (To see the complaint letter, click here).

Democracy Watch has called on the Ethics Commissioner to resign and filed an application in court in September 2005 claiming the Commissioner is biased against enforcing ethics rules (September 29, 2005 news release about court application), which the Ethics Commissioner has challenged through a preliminary motion that is awaiting a hearing.
